The law on drunk driving that Utah attorneys practice has stirred quite some noise. The Driving under the influence ruling has been deemed extreme as bicycles are stated to be part of this ruling. When the word bicycle was defined by a judge, the judge explained that bicycles are included in the rule as a vehicle.   So, riding a bike drunk can get you a ticket or an arrest for driving under the influence of alcohol.

The State of Utah imposes the strict implementation of driving a motor vehicle with a .08 percent or above, blood alcohol concentration (BAC). Its the standard all over the United States, however, Utah has lower BAC limits for commercial drivers (.04) and a Zero tolerance law for drivers under the age of 21. The Utah DUI law is also very strict on driving if you are under the influence of substances such as marijuana, cocaine, inhalants and other intoxicants.

Trying to Get out of it

Yes, these attorneys may charge a couple hundred bucks more than the other attorneys, but at least you have better chances of recovering from bankruptcy.

Questions to ask
Before you enter into a retainer with an attorney, make sure you ask a few simple questions to gauge his knowledge and experience. Someone experienced in bankruptcy law should not get offended if you ask them clarifying questions; instead they should be happy to assist you and thank you for allowing them to advertise themselves to an interested audience.

The new bankruptcy laws had taken effect in 2005. You should figure out how many bankruptcy cases the attorney has handled since 2005, and whether he had been handling bankruptcy cases before 2005. Ideally you’re looking for an attorney that has plenty of both – cases before and after 2005. An attorney that only has cases before 2005 may have too many preconceptions that can affect his handling of the bankruptcy under the new law. An attorney with only cases after 2005 will not appreciate the changes and the rationale behind them, and may miss out important details when preparing for the case.

The attorneys you are considering should also know who the local bankruptcy judges are as well as the names of the local Chapter 7 trustees. Law, like many kinds of professional services, primarily depends on networking. Make sure the attorney who will represent you knows, and is recognized by the same people who will hear your case.

All Florida attorneys that become uncomfortable or flat out deny answering these questions to your satisfaction should not be trusted with a major lifetime event such as a bankruptcy – move on and find another one.

California Governor Arnold Schwarzenegger was ordered by a judge to cease and desist forcing state employees to go on unpaid leaves three times a month which affected groups represented by the Union of American Physicians and Dentists as well as California attorneys. These forced unpaid leaves were meant to resolve a budget shortfall that had been plaguing California last year.

Not the worker’s fault
The judge argued that it was the Legislature’s fault that the budget was not passed on time or that the resulting budget that did pass did not take into account the state employees’ condition. Because of this, the argument that these furloughs are necessary to balance the state budget is superfluous.

In fact, the state employees’ union had negotiated a five percent reduction in the contract in recognition of the budget problems. However, the thrice a month forced unpaid leaves effectively means a reduction in pay of about 15%. This additional reduction prompted the lawsuit filed by the union consisting of  California attorneys, physicians, and dentists

Furthermore, the governor’s decision may have been illegal as it interferes with the mandate of government institutions that get their funds from special sources. Among these institutions are those in the Department of Motor Vehicles that get their funds from license fees, and the employees of the Social Security system that have a separate fund for handling disability claims.

Grave abuse of discretion
Governor Schwarzenegger believes he has the absolute authority on issuing unpaid leaves but the judge considers this particular instance as abuse of discretion. The judge reminds the governor that there are institutions that get their funding from a special fund and that the employee wages of these institutions do not come from the state budget.

Most of the representatives of the state employees affected by the forced leaves agree that the governor should start re-negotiations and stop acting one-sidedly. They feel that the court ruling in their favor is a clear message to the governor to go back to the bargaining table.

In fact, the union representatives believe that even without the unpaid leaves, a good explanation of the problems at hand may cause the employees themselves to create budget savings. Some California attorneys think that much budget savings can be realized if corruption is minimized.

The governor notes that even if he is planning to appeal the decision, since there is already an order to stay the furloughs, the order will be obeyed at least until the appeal has been ruled on. A spokesman for the governor also mentioned that he feels the Supreme Court will rule in the state’s favor.

Hopefully, the California attorneys will prevail even when the case is brought to the Supreme Court.

The Mississippi attorneys comprising the defense panel mishandled a complaint and was slapped by a default judgment. The Mississippi Court of Appeals had recently held this judgment, further inflaming the county’s reaction on the mishandling of the complaint. Some Facts of the case: What happened was, a suit of negligence and gross negligence was filed against Tippah County, Mississippi due to some altercation on who should take custody of the plaintiff’s elderly while committing them for mental evaluation and checkup.

However, during the handling of these elderly, an accident happened and one of the elderly fell to the ground. As a result, he was handcuffed to prevent further injury to his arm. Of course, these injuries had to be treated along with the medical evaluation.

Inaction by the insurance agent

Now the plaintiff sent claims to the Mississippi county to reclaim the costs of the medical evaluation as well as the treatment of the wounds. The Mississippi attorneys relegated the claims to their insurance agent, as they are the ones who handle these types of claims.

However, the insurance agent apparently forgot the claim, and took no action. The Mississippi attorneys representing the county neither did follow up on the insurance agent as well. Thus the plaintiff moved for default judgment, and it was granted.

Negligence inexcusable

The Mississippi appeals court ruled that the behavior of the county was negligent, and it fell upon them to see to it that an answer was filed. This means that the county is directly responsible for paying the plaintiff the costs of the medical evaluation and treatment of injuries. The county is now required to pay a whopping $250,000 to the plaintiff.

The county argued that however that the insurance representative was at fault, and did not properly bring the claims to his company for proper disbursement. However, the Mississippi court of appeals did not buy this reasoning, since it believes that the responsibility to ensure that the claims reach their intended destination belongs to the county, not to the insurance representative.

The county is not without recourse however; they can probably go after the insurance agency that sat on their hands and did not reimburse the medical costs. All these could have been prevented though, if only the county was responsible enough to remind their insurance provider that a claim is still under contest.

Mississippi attorneys, make sure you learn the lesson well: if the insurance provider does not answer the claims, you are liable; so it is your responsibility to remind them of their obligations.
