DUI Laws for Utah Attorneys, Is It Extreme? By Florida Lawyers

The law on drunk driving that Utah attorneys practice has stirred quite some noise. The Driving under the influence ruling has been deemed extreme as bicycles are stated to be part of this ruling. When the word bicycle was defined by a judge, the judge explained that bicycles are included in the rule as a vehicle.   So, riding a bike drunk can get you a ticket or an arrest for driving under the influence of alcohol.

The State of Utah imposes the strict implementation of driving a motor vehicle with a .08 percent or above, blood alcohol concentration (BAC). Its the standard all over the United States, however, Utah has lower BAC limits for commercial drivers (.04) and a Zero tolerance law for drivers under the age of 21. The Utah DUI law is also very strict on driving if you are under the influence of substances such as marijuana, cocaine, inhalants and other intoxicants.

Trying to Get out of it
Since then, several Utah attorneys have handled several of these cases and had been so familiar that they apply the following and get your client out of jail.
1. This is not a federal case therefore there will be no jury around.  You will only be heard by judge who once has to be prepared thoroughly considering that only one will only be present during the trial. Since the judge will be making the decision and not a jury, the judge will definitely would want all the information he could get prior to the decision.
2. Prepare yourself to bring it all out - evidences etc. Utah attorneys must make the “prosecution work and should really be prepared.”
3. Once a Driver is caught, Utah attorneys  would immediately file a motion to avoid the arrest, validity of the Breath Test and all other things that may be used against the client.

5. Judges in Utah are very strict. However, if they find your reasons to be worthy, do not antagonize the judge anymore.

An example of extremely how strict the judges are in court is a driver of a bicycle was recently charge of violating the DIU Law.  Bicycle, being a vehicle is still classified under the law of Utah as part of the Driving Under the Influence rule.

A Lesson Learned
With the number accidents and deaths due to drunk driving, we can’t blame the judges and Utah attorneys for making stricter rules and implementing them with an iron hand. If we can’t get ourselves straight, someone else will. Because if they don’t. They have to clean up the mess afterwards while drunk drivers are likely to still be groggy and dizzy. If given a choice between strict rules and gruesome accidents, perhaps we’re better off with stricter rules. But lawmakers and judges might have to draw the line at bicycles and drunk driving. But then again, we never know what else they could come up with. Let this be a lesson to drivers, never underestimate  the law. And always allow Utah attorneys  to interpret  the law.
